Terms of sale

These General Terms and Conditions of Sale (the “GTC”) apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers (“Clients” or the “Client”) wishing to purchase the products offered for sale (“Products”) by the Seller on the Wally’s Vintage website.
The Products offered for sale on the website are second-hand clothing.

Article 2 – Products
The Products governed by these GTC are second-hand clothing displayed on the Seller’s website and indicated as sold and shipped by the Seller. They are offered subject to availability.
The main characteristics of the Products, in particular their condition and level of wear, are presented on the website. The Client is required to review them before placing any order. The choice and purchase of a Product are the sole responsibility of the Client.
The photographs and graphics presented on the website are not contractual and shall not engage the Seller’s liability. The Client is required to refer to the description of each Product to be aware of its essential properties and characteristics.
Article 3 – Prices
The Products are supplied at the prices in force shown on the website at the time the order is registered by the Seller. Prices are expressed in euros (€).
In accordance with Article 293 B of the French General Tax Code (CGI), VAT is not applicable to the Seller’s sales. Prices are therefore shown exclusive of tax (excl. VAT) and will not be subject to VAT.
These prices are firm and non-revisable during their period of validity; however, the Seller reserves the right, outside this period, to modify prices at any time.
Prices do not include processing, shipping, transport, and delivery costs, which are charged in addition under the conditions indicated on the website and calculated prior to order confirmation.
The payment requested from the Client corresponds to the total amount of the purchase, including these costs. An invoice is issued by the Seller and provided to the Client upon delivery of the ordered Products, stating “VAT not applicable, Art. 293 B of the CGI.”
Article 4 – Orders
The Client selects the Products they wish to order on the website as follows: the Client chooses a Product and adds it to their cart. The Product may be removed or modified before the order is validated and these GTC are accepted. The Client then enters their details or logs into their account and chooses a delivery method. After validation of the information, the order becomes final and requires payment by the Client under the specified terms.
The sale is considered valid only after full payment of the price. It is the Client’s responsibility to check the accuracy of the order and to immediately report any errors.
Any order placed on the website constitutes the formation of a distance contract between the Client and the Seller. The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute relating to payment of a previous order.
Article 5 – Payment Terms
The price is paid via secure payment, according to the following methods:

The price is payable in full by the Client at the time the order is placed. Payment data is exchanged in encrypted mode using the protocol defined by the approved payment service provider handling banking transactions on the website.
Article 6 – Delivery
Products ordered by the Client will be delivered within mainland France with a dispatch time of 2 days, to which the carrier’s delivery time is added, starting from the date the order is shipped, to the address provided by the Client when placing the order.
Delivery consists of the transfer to the Client of physical possession or control of the Product. Except in special cases or where one or more Products are unavailable, ordered Products will be delivered in a single shipment.
The Seller undertakes to make its best efforts to deliver the Products within the timeframes indicated above. In the event of a delivery delay, the Client may cancel the contract under the conditions set out in Article L.216-2 of the French Consumer Code.
Article 7 – Right of Withdrawal
In accordance with applicable legal provisions, the Client has a period of 14 days from receipt of the Product to exercise their right of withdrawal with the Seller, without having to justify reasons or pay penalties, for exchange or refund, provided that the Products are returned in their original condition and complete within 14 days of notification of the withdrawal decision.
Returns must be made in their original and complete condition, allowing the Products to be resold. Damaged, soiled, or incomplete Products will not be accepted.
The right of withdrawal may be exercised online using the withdrawal form available on the website, or by any other clear statement expressing the intention to withdraw. If the right of withdrawal is exercised within the specified period, only the price of the purchased Product(s) and the delivery costs are refunded; return shipping costs remain the responsibility of the Client. The refund will be made within 14 days of notification to the Seller of the withdrawal decision.
Article 8 – Legal Guarantees
Products sold on the website comply with the regulations in force in France and benefit, without additional payment and independently of the right of withdrawal, from the legal guarantee of conformity and the legal guarantee against hidden defects.
